Homeowners Beware of DIY Home Repair Dangers - 23 Dec 2016 15:29

[
]In this economy, "do-it-yourself" home repairs have never sounded so good, and penny pinchers across the country are rolling up their sleeves, opening their toolboxes, and tackling home projects.

With the help of the Internet, TV advice shows, and some basic tools, you may wonder if you need a professional at all.

But "do-it-yourself" isn't always as easy as it may seem.

Cathy and Will Huiras of Fishers, Ind., thought moving their stereo cabinet from one place on their wall to another would be simple.

null

"We thought we had found a stud in the wall and unfortunately, we drilled into a copper pipe," Cathy said. "At the Resources time, it didn't produce any water. We thought we were safe."

Several months later, however, the water finally appeared, in little puddles on the carpet.

Will Huiras said a large area of their living room was affected by the water.

"The dry wall had to come out," he said. "The paint bubbled and we had to peel all the paint off the wall and peel off the old, wet, sticky dry wall."

"It turned out to be quite a horrific day," Cathy said. "We turned the water off but water was still squirting out. The carpet was a mess. It was quite an ordeal."

After hiring pros to fix the pipe and install new dry wall, the couple was out close to $500.

Despite horror stories like that, other happy homeowners are still picking More hints up their hammers.

In a recent Time magazine poll, 36 percent of people said they are spending less on home improvements, but 23 percent said they are doing more home repairs themselves rather than hiring help.

The argument for going with the pros isn't just about saving money in the long run. It's also about saving yourself. Emergency room doctors say they have treated more do-it-yourself injuries in the past year as people cut corners to save money.

Matt Taylor of Danville, Ill., might have avoided a 3-and-a-half inch nail in his wrist if he'd hired an expert. He was framing a door in his basement when things went awry.

"I really just should've had two hands on the nail gun and this would never have happened," Taylor said. "I was above my head — I had my left hand down to the side, and I was shooting it use this link into a board. When it recoiled back, it popped back and came straight down into my wrist."

Taylor said he "screamed like a little bit of a girl," but fortunately, doctors were able to safely remove the nail.

"I think definitely the economy has played a role in consumers wanting to do more projects on their own," said Angie Hicks, the founder of Angie's List, the popular Web site based in Indianapolis, Ind., that gives consumer reviews of contractors.

"Consumers can certainly spend more money on a do-it-yourself project," she said, "especially if they are investing in equipment that they don't have and if they really get in over their head."

Contractor Eric Schneller, from Crew Property and Improvement Specialists, in Carmel, Ind., often gets calls from homeowners who are in too deep — literally.

"They'll try to put up a shelf and pull down the drywall, because they didn't find a stud," he said. A Guide to Buying a Property in Malta by Les Calvert - 12 Dec 2016 05:51

Tags:

[
]Overview

There are some restrictions on what types of real estate a foreign national can own in Malta. Generally speaking, a foreign national is able to buy one piece of residential property that will be used as that person's primary residence or that will be used by that person as a holiday residence during part of the year.

With this in mind, an individual foreign national is not able as a general rule to buy commercial or industrial real estate in Malta. There are some instances in which a foreign national will join with citizens of Malta to form a joint legal venture — usually in the form of a limited liability company — to by non-residential real estate. It is important to keep in mind that this type of arrangement does require approval from different governmental agencies in Malta.

Even for EU member state nationals (Malta is now a part of the European Union) the ability to own real estate in the country is limited at this point in time. There is some natural and necessary movement to relax different real estate laws in regard to foreign nationals in the future to bring Malta more inline with the open market concept that is the centerpiece of EU membership.

Investment Real Estate

As has been set forth previously, there are some pretty stark limitations on what type of real estate a foreign national can purchase in Malta. With this in mind, the opportunities for investment in real estate — beyond the ownership of a primary residence or a holiday home — by a foreign national are limited.

Again, and as was discussed, there are some instances in which a foreign national will join together with citizens of Malta, to develop a legal entity that will take possession of real estate in that country for investment purposes. Even with this noted, the number of foreign nationals who are involved in such a venture is not significant due to the hurdles that must be surmounted in order to win governmental approval and authorization to purchase real estate beyond a residence.

There may be some relaxation in the laws governing investing in real estate by foreign nationals who are from European Union nations in the future. Of course, the concept behind the EU is to allow for a free economic flow between member nations. Thus, with Malta now a part of the EU, it is likely that there will be changes in its real estate laws as they same pertain to investment in different types of real estate in the country by citizens from other European Union nations.

Residential Real Estate - Single Family Dwellings

Generally speaking, it is only residential real estate that can be purchased at this time by foreign nationals in Malta. Although Malta has joined the European Union, where there can be found a broader ability of foreign nationals who are from EU member countries to by real estate within the EU, this barrier has not been fully surmounted in Malta.

The primary reason that there is a heavier restriction on foreign investment in real estate arises from the fact that there is, indeed, only a limited amount of real property available to sale within the borders of that country. Unlike many other nations, that still have undeveloped frontiers and a significant amount of space still available for development, such is not the case with Malta.

A foreign national, with relative ease, can make the purchase of one piece of residential real estate — either to be used as a private and personal residence or as a holiday home. This will be discussed in greater detail shortly.

Many Europeans have purchased larger homes in Malta that have become favored second residences, holiday homes. A foreign national can stay within Malta for a period of up to three months at a stretch with no tax consequences or special filing requirements. A foreign national can spend between three to six months in consecutive succession in Malta with permission of the government. Generally, there will be no additional tax consequences on a foreign national in Malta until that person remains in country for a period beyond six months.

Residential Real Estate - Apartments

Upscale apartments remain attractive choices for foreign nationals looking to purchase real estate in Malta. As will be discussed shortly, a foreign national can make the purchase of residential real estate in Malta provided the property is valued at $50,000 MLT (the Maltese national currency) as is to be used only as private primary residence or as a holiday home by the purchaser.

These apartments — high end apartments — are in significant demand by foreign nationals at this point in time. These people, who enjoy spending part of the year in Malta (with its idyllic climate and easy lifestyle) are attracted to these apartments.

Vacation Real Estate

With its nearly perfect climate the entire year around, Malta has long been a favored travel destination for men and women from different countries around the world. The trend has continued unabated into the present day and age.

As a consequence, there is a growing number of foreign nationals who are interested in finding real estate to purchase in that country for holiday or vacation foreclosure purposes. Indeed, as will be discussed shortly, there are general limitations on the ability of a foreign national to purchase real estate in Malta, generally restricting these men and women to being able to purchase one piece of residential property that can be used as a holiday home or as a permanent residence.

Successfully Purchasing Real Estate in Malta:

Specific Steps to Buying Real Property in Malta

Despite the fact that the real estate purchase process in Malta is a relatively easy process, there are some definite restrictions that apply to foreign nationals who are interested in purchasing real estate in Malta.

Generally speaking, a foreign national can purchase a residence in Malta that is going to be used either as a holiday home or a that purchaser's primary residence into the future. In addition to this general restriction, there are some more specific requirements when it comes to a foreign national investing in real estate in Malta.

First of all, the value of the real estate that is being purchased must not be less than 50,000 MLT (the national currency in Malta). Second, all of the funds that are used to purchase this real estate must be derived from outside of the country. Third, the real estate that is purchased cannot be rented out to anyone else. This includes property that is purchased for occupancy as a holiday home during only part of the year. Unlike in many other countries around the world, a foreign national buying such a residence in Malta cannot lease out the property to someone else when it is not in use by the purchaser and owner. There is one interesting exception to this prohibition. The owner of a residence with a pool can, in fact, lease or rent out the property to someone else when he or she is not utilizing the property for his or her personal benefit.

Finally, on resale, a foreign national can repatriate the funds generated from the sale to his or her own country of origin.

Once these restrictions are appreciated and understood, the actual process of buying and selling real estate in Latvia is simple. The initial phase involves the execution of a contract for sale. At this time, the buyer is obliged to post a deposit that normally is in the amount of 10% of the overall purchase price of the real estate.

The preliminary agreement normally is valid for a period of three months. During this time period, the purchaser will obtain financing and the seller will make sure that there are no defects associated with the title that will prevent a clear conveyance of the property to the purchaser when the sale is concluded.

The final contract ultimately is entered into between the parties. It is at this time that the buyer pays the remaining balance due and owing on the property. Additionally, it is at this juncture that the buyer will take physical possession of the real estate.

There is some effort in Malta at the present time to relax at least to some degree (and most likely for residents of other EU member nations) the real estate laws in that country. Most of the proposals that are being considered center on allowing foreign nationals a bit broader usage with their residential property. For example, there are proposed laws being considered that would allow a person who owns a holiday home or residence in Malta the ability to rent or lease that property to someone else during those times of the year when the owner is not personally utilizing the real estate in question. Again, any such changes more than likely will be targeted towards citizens from EU member nations.[
] - Comments: 0

The Importance Of Client Confidentiality - 06 Dec 2016 15:21

While the attorney-client privilege protects communications between a client and his or her attorney from disclosure before a court, confidentiality protects a client from any information a client chooses to share with his or her attorney.

Policy

Why is confidentiality such an integral aspect of legal representation? The answer is trust—to effectively represent a client, an attorney needs the client's complete trust. Think of it this way, we are all more willing to share information that may be embarrassing or difficult to talk about with someone that we know we article source can trust. This is why attorneys are held to a high standard of protecting a client's confidential information.

Confidences and Secrets

With respect to client confidentiality, the definition of a secret is anything either the client has requested to be held in confidence or anything that, if told, would be detrimental to the client. Confidential information is any information related to the representation of the client. Furthermore confidential client information can only come from the client, whereas a client's secrets can come from any source.

Informed Consent

Only the client can give permission for his/her confidential information to be released. A client may give permission by "informed consent". Informed consent requires the client to be made aware of the drawbacks and consequences of allowing their information to be made public. Asking your Lawyer to Remove Themselves by Mark Shapiro - 20 Nov 2016 02:24

[
]I am not https://flsecuritiesarbitration.wordpress.com/finra-broker-checks/ a lawyer. If you need legal advice, contact a lawyer.

When you purchase a Judgment, you can either hire a lawyer to represent you in court or you can (much more likely) represent yourself Pro Se (also known as Pro Per, meaning without a lawyer representing you.)

The reason you can represent yourself in court is the Sixth Amendment of the U.S. Constitution. In addition to guaranteeing a trial http://www.friendsindeed.org/tag/child-custody/ by jury, it provides for self-representation in any court of law. The decision has been upheld in every state. You can represent yourself in all legal proceedings. However, unless you are a licensed attorney, you cannot represent another person.

When a judgment enforcer looks at judgment cases, they will find and purchase judgments where the Original Judgment Creditor (OJC) had to hire a lawyer to file the lawsuit and win the Judgment.

You may be fortunate enough to discover your OJC has already paid his lawyer in full, with no remaining balance owed to the lawyer. Even then, in some states, you may need to have your OJC request that their lawyer remove themselves as the lawyer of record in the court the judgment was awarded at.

The lawyer is usually not listed on the judgment enforcer's Assignment of Judgment form - only the original judgment creditor signs it under a notary's supervision. The Judgment Enforcer's purchase agreement often names, and is signed by both the OJC and their lawyer.

Even when lawyers remove themselves, they will still be owed money for their fees, and may file a claim in court for such fees. The OJC is obligated to pay those fees, and you probably should make sure your purchase agreement addresses the payment of all lawyer fees.

Some lawyers will file suit and win a Judgment with the OJC retaining the lawyer on a contingency basis. When this is done there may be fees to be paid out of any recovery made on the judgment. In this situation the OJC must request the lawyer to remove himself or herself as the lawyer of http://www.fortsamhoustonmwr.com/family-lawyer-md-mallon/ record.

In most states, when a lawyer removes himself or herself from representation on a judgment, they use a (usually) court-provided Substitution Of Attorney form. This form is used even when there is no new attorney. With no new attorney, the OJCs is representing himself or herself.

Although there are forms available to send to the OJC, it is smarter to request the OJC to ask their lawyer or former lawyer to remove themselves as attorney of record. If you are not a lawyer, note that if you prepare a substitution of attorney form for the lawyer, you always should be careful that your actions are not for "a client" as that could be interpreted as an Unauthorized Practice of Law (UPL).

Once in a while you will run across a lawyer that wishes to charge more than the OJC is willing to pay. You also may find that the lawyer has no interest in preparing or signing a substitution of attorney form for the OJC.

If the lawyer will not cooperate, the OJC can go to the attorney's office to thank them for winning the case, and explain that this is a way to start repaying the attorney's fees. As soon as the money comes in, they will be paid. Most lawyers will be happy to hear this and sign a substitution of attorney form.

http://www.articlecity.com/articles/legal/article_2043.shtml[
] - Comments: 0

Designing an HVAC System - 18 Nov 2016 23:48

[
]Ductwork is Very Important to HVAC System Performance

Proper duct sizing has much to do with the performance of your HVAC system. Often when people complain of having colder rooms or areas of their home, it is a result of improper duct sizing or register placement.

A duct-u-lator is often used in sizing duct these days though there is what is called a manual "D" formula for doing this as well. In order to size duct properly, we must start with the plenum, the duct work installed directly on top of the furnace and coil. This must be sized to handle the total amount of air that is produced by the furnace. From there, we decide how much is going in one direction and how much is going in the other. The first 2 pieces of horizontal supply duct will now be sized to handle that amount of airflow. As supply runs are taken off of this main trunk line, we will deduct that amount of air that is leaving the trunk and down size the trunk line to carry the remainder. This shrinking of the duct as it goes down the line helps to maintain the proper amount of air pressure and velocity until we finally reach the end of the duct where it will be sized to hold whatever air is left.

The return duct works the same however the last piece of duct is the one located near the furnace since this is where the air finally returns to the unit. This last piece is often referred to as the collector and must be able to handle the entire amount of air returning to the unit. The duct again will shrink as it goes away from the unit but in this case it is because it's collecting more and more air as it returns to the unit as opposed to the supply which is giving up air as it leaves the unit.

NOTE: Most supply runs will be ran out to the register in 6" piping. Some larger rooms may use 7" piping. As for return air runs, it's common that the entire joist space coming from the return register to the duct is sealed off to carry as much air as possible. "You can never have too much return air" some may say and it does help the unit to run quieter and with more ease.

Example of Duct Sizing Mathematics

Let's say you have a 2,000 (5 tons) CFM fan motor and the system has 10 heat runs going each way off the unit. You will need a 1,000 CFM to go each way for even flow and that 1,000 CFM will mean each run will get 100 CFM to it. Again, this is an example but let's go with 20" x 8" duct each way. In the first 8ft. of duct you take off 4 - 6" supply runs each supplying 100 CFM. Now, instead of needing your duct to carry 1,000 CFM, you only need it to carry 700 so we shrink it down to the proper size to maintain airflow. You would keep doing this as you go down the line until all the supply runs have been fed. The same train of thought would apply to return air ducting however you'd be looking to draw around 200 CFM per return. These are nice easy round numbers but the truth is if you only had 20 supply runs, your 2,000 CFM fan is likely a bit too big and wouldn't be working as well as it could.

Where to Locate Supply and Return Registers

Choosing the right location for your registers is important to how well your home evenly heats and cools. It is also important to your energy bills.

Putting supply registers in the middle of a room isn't a good idea though you'll find them there often in older homes. Now in the defense of our predecessors, they were working with gravity heat as opposed to forced air but this design allows the cold or heat to penetrate too far into our homes before being confronted. Registers are to be strategically placed around the perimeter of the rooms in our homes. Under windows, beside doors, etc…this is to stop the elements from getting much past our exterior walls and to attack at the coldest points of those exterior walls. Another added benefit of this placement is that it is less likely to be covered up by furniture and such.

As for our return air registers, they are better placed on the interior walls as far as possible from our supplies to help draw the supplied air through the room. It is again important to try to place them where they will not be covered up. As I mentioned above, you can never really have too much return air and when we choke these off, we starve our furnace fan for air. Think of your furnace somewhat like a lung only that it can inhale and exhale at the same time. We cannot do that and your fan cannot do them separately. Try to exhale find out this here for an extended amount of time without bringing any air back in…doesn't work out to well does it? This is what the fan is feeling if it doesn't draw air in and in time, it will overheat, work too hard, and ultimately it will break down.

NOTE: This is also where our furnace filter comes in. You can have all the return air in the world but if your filter is clogged, it means nothing because the fan cannot draw air from them through a clogged filter.

Are You Ready to Design Your Home's HVAC System?

Okay, I highly doubt that anyone is going to sit down with the wife and kids to work out a manual "J" or run the numbers for their exact BTU needs, but I do Continue hope that if you're considering building a home or having a new system put into your existing home, this information will come in handy. Knowledge is power and if you know even the slightest bit about the principles of HVAC, you will feel more secure in the decisions you make and knowing that your eyes are wool free when dealing with contractors.

Happy home-owning!

http://hubpages.com/living/Designing-an-HVAC-System[
] - Comments: 0

JPMorgan Chase CEO Jamie Dimon to Get a Pay Raise - 15 Nov 2016 01:46

[
]After overseeing JPMorgan Chase while the bank paid about $20 billion in penalties last year to federal authorities, CEO Jamie Dimon is reportedly getting a 74 percent pay raise, according to a filing with the Securities and Exchange Commission.

JPMorgan's board voted this week to increase his 2013 compensation, after cutting his pay in half by $11.5 million last year in response to the "London Whale" rogue trading debacle that cost the bank billions. Much of the increase the CEO would receive comes in the form of performance-based restricted stock.

A spokeswoman for JPMorgan Chase declined to comment. In a regulatory filing, the company said it took these factors into account in setting Dimon's pay: "…the Company's sustained long-term performance; gains in market share and customer satisfaction; and the regulatory issues the Company has faced and the steps the Company has taken to resolve those issues, including those arising from events at Washington Mutual and Bear Stearns that predated the Company's ownership. Under Mr. Dimon's stewardship, the Company has fortified its control infrastructure and processes and strengthened each of its key businesses while continuing to focus on strengthening the Company's seo optimization leadership capabilities across all levels."

On Friday, the bank's filing with the SEC indicates he is receiving $20 million for 2013, including a base salary of $1.5 million that remained flat with the prior year.

Back in 2011, he received the highest pay, $23.1 million, for any chief at a large bank.

Here's a look at some of the things that have happened since then. You decide whether he deserves a raise.

1. JPMorgan Chase Stock is Up

While Dimon oversaw JPMorgan during a tumultuous last 12 months, shares of the company are up over 20 percent in that period.

"It's a tough decision for the board," said James Sinegal, banking analyst with Morningstar. "The company is making billions every quarter and its stock is at an all-time high."

For comparison, the S&P Financials Index, which includes all the major banks, rose 33 percent last year.

Read More: What Billionaires Wager During March Madness: Warren Buffett and Dan Gilbert

"Despite the legal costs, they've still been able to be profitable," said Aaron Boyd, director of governance research at executive compensation research firm, Equilar.

Last week, JPMorgan reported that its fourth-quarter profit fell 7.3 percent to $5.28 billion.

In October, the bank reported its first quarterly earnings loss under Dimon.

Despite all the settlements, JPMorgan still made $17.9 billion in reported net income last year.

Brian T. Foley, managing director of consulting firm Brian Foley & Co., said Dimon's latest cash compensation amount - the same $1.5 million base salary as last year without a cash bonus — was "clearly conservative."

Foley said the board likely believes some of the settlements "appear to be the result of very aggressive actions by regulators" and that they had already imposed a "very significant pay cut" in 2012.

"When all is said and done, Jamie continues to be a strong leader," Foley said.

3. $13 Billion Settlement Over Troubled Mortgages

In November, the Justice Department announced that JPMorgan Chase agreed to pay $13 billion to settle claims over the sale of troubled mortgages.

The bank said the deal resolved most of its mortgage issues with federal authorities, but it could still face criminal charges. Many of the problems were at Bear Stearns and Washington Mutual, both of which JPMorgan bought after the government asked the bank to step in when those companies were steeped in financial difficulties at the start of the 2007-08 financial crisis.

Watch: Chase to Pay $13B for Selling Bad Mortgages

"I also think Dimon can also be excused for failing to foresee some of the legal issues that came out of Bear Stearns and WaMu," Sinegal told ABCNews.com. "But you also have to wonder whether the number and variety of fines and settlements over the last couple of years are indicative of widespread cultural problems at the bank."

Earlier this month, prosecutors said the bank would be able to avoid criminal charges despite having "turned a blind eye" to evidence of the Ponzi scheme of Bernie Madoff, whose principal accounts were held by the bank for 22 years and were central to his multi-billion dollar fraud. The bank agreed to pay $1.7 billion to defer for two years criminal charges that it failed to report suspicious activity that might have tipped off investigators to Madoff's scheme years earlier and $350 million to cover civil penalties for violations of the Bank Secrecy Act. JPMorgan also agreed to pay $543 million to settle civil suits filed by victims of Madoff's Ponzi scheme.

Read More: Once Again, Is JPMorgan Chase Too Big to Jail?

Though the recent settlements are costing the bank billions, the financial and reputational damage could have potentially been worse had it not been for Dimon's leadership, said Boyd.

"Just hours before the Justice Department was planning to announce civil charges against JPMorgan over its sales of shaky mortgage investments in September, Mr. Dimon personally reached out to Attorney General Eric H. Holder Jr. — a move that averted a lawsuit and ultimately resulted in the brokered deal," the New York Times reported.

In Photos: Forbes' Richest Americans Led by Bill Gates for 20th Time

"Dimon's standing in the investment community is about as low as it's ever been, and it seems like some JPM directors are feeling the same way," Sinegal said.

The New York Times reported that a "vocal minority" within JPMorgan's board was in favor of keeping his pay flat this year.

Boyd seo companies said any board considers many factors in determining a CEO's pay, including the bottom line, public perception, and the proper incentives for a chief executive.
